1. Acceptance of Terms

By accessing and using RecallNote, you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services. Any participation in this service will constitute acceptance of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

RecallNote provides users with AI-powered study tools, including the ability to generate summaries and flashcards from uploaded notes and documents. You understand and agree that the Service may include certain communications from RecallNote, such as service announcements and administrative messages, and that these communications are considered part of RecallNote membership.

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to provide true, accurate, current, and complete information about yourself as prompted by the Service's registration form. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.

4. User Content

You retain all rights and ownership in your content. RecallNote does not claim any ownership rights in your content. However, by uploading content to RecallNote, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your content solely for the purpose of providing the Service to you (e.g., generating summaries and flashcards). We will not share your content with third parties except as necessary to provide the Service or as required by law.

5. AI Disclaimer

The summaries, flashcards, and other content generated by RecallNote are created using Artificial Intelligence. While we strive for accuracy, AI models can make mistakes ("hallucinations"). You should always verify the generated content against your original notes and study materials. RecallNote is a study aid, not a replacement for comprehensive learning and verification. We make no guarantees regarding the accuracy, completeness, or reliability of the AI-generated content.

6. Prohibited Conduct

You agree not to use the Service to:

• Upload any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Upload any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships.
• Upload any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware.

7. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Limitation of Liability

In no event shall RecallNote, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

9. Changes to Terms

RecallNote reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
